MOECC reviewing application for judicial review

The Ministry of Environment and Climate Change (MOECC) is considering their next move, after a judicial review application was filed against them over the alleged failure to protect the public from industrial wind turbine noise.

Meanwhile, representatives with the Otter Creek Wind Farm project, planned for north of Wallaceburg, say they remain committed to providing a “safe and positive project” for the community.

Gary Wheeler, spokesperson for the ministry, told the Sydenham Current they are reviewing the Notice of Application for Judicial Review brought by the Dutton/Dunwich Opponents of Wind Turbines.

“We will be determining the appropriate next steps,” Wheeler said.

“As this is an ongoing legal matter, providing additional comment would be inappropriate.”

Wheeler said the MOECC takes their regulatory role “very seriously.

“Regarding guidelines, the ministry’s top priority is the protection of the environment and human health,” Wheeler said.

“When it comes to wind turbine projects, the companies involved must meet our stringent noise standards through noise audits and the ministry’s Compliance Protocol for Wind Turbine Noise. We work closely with the companies to ensure they are meeting the standards set out.”

Officials with the Otter Creek Wind Farm project told the Sydenham Current they are aware of the judicial review application filed against the MOECC on Thursday.

“We remain focused on ensuring the Otter Creek Wind Farm is a safe and positive project which offers significant benefits to both the community and the environment,” company officials say.

The Wallaceburg Area Wind Concerns group has joined forces with three other like-minded groups to submit the application against the MOECC.
