Cannabis details from the Public Health Unit

As of October 17, 2018, recreational cannabis is legalized for use and purchase in Ontario by adults age 19 and older. Cannabis use is impacted by Federal and Provincial laws, as well as Municipal By-laws.

This information from the Chatham-Kent Public Health Unit aims to help residents understand some of the health facts, rules, and regulations related to cannabis use.

Where you can and can’t smoke or vape in Chatham-Kent:

The Smoke Free Chatham-Kent By-law prohibits: the use or carrying of any lighted/heated cigar, cigarette, pipe, Waterpipe, or any other equipment used to inhale, exhale, burn, or heat any Smoking Product. Smoking Products are any tobacco or tobacco-like product whose primary purpose is to be burned or heated to produce vapours, gases, or smoke, which are inhaled, and shall include but is not limited to non-tobacco herbal shisha, and other plant material or oils intended for inhalation.

Smoking/vaping (including recreational and medical cannabis) is NOT permitted in the following areas in Chatham-Kent:

• Restaurant/bar patios and public areas, including the sidewalk, within 9 metres of the patio
• Enclosed public places and workplaces
• Schools, school grounds, and public areas, including the sidewalk, within 20 metres of the perimeter of those grounds
• Workplace vehicles
• Hospitals and hospital properties
• Municipally-owned and operated: beaches, parks, playgrounds, sports fields/complexes, housing services properties, and other locations open to the public
• Community recreational facilities and public areas, including the sidewalk, within 20 metres of the perimeter of those grounds
• Places where home childcare is provided, regardless of whether children are present
• Child care centres and places where an early years program or service is provided
• Indoor common areas in condominiums, apartment buildings, and university and college residences
• Vehicles and boats being driven or under someone’s care or control
• Multi-unit dwellings with smoke-free policies

Note: Smoking tobacco or using an e-cigarette is NOT permitted in a motor vehicle while another person who is less than 16 years old is present in the vehicle.

Where smoking/vaping (including recreational and medical cannabis) is permitted in Chatham-Kent:

• Privately-owned residences
• Sidewalks adjacent to a public roadway
• Research and testing sites
• Designated hotel rooms
• Outdoor private property
• Residential vehicles or boats, that are parked or anchored, and are fitted with permanent sleeping accommodations and cooking facilities

Cannabis use presents a higher risk to some people.

Some groups of people have a higher or unique risk for cannabis-related health problems. People in the following groups should consult with a physician prior to using cannabis:

• People with a personal or family history of mental health issues
• People with a current/history of addictions
• Pregnant and breastfeeding women
• Youth under the age of 25

Chatham-Kent Public Health can assist you in:

• Developing supportive workplace policies
• Business and property owners can opt-in to be regulated by the Smoke Free Chatham-Kent By-law Supporting parents, teachers, and youth service providers in preventing and delaying substance use in Chatham-Kent youth
• Supporting residents who use substances and are looking for help
