The Municipality of Chatham-Kent is advising residents that the upcoming court date related to the proposed York1 landfill in Dresden has been rescheduled.
The matter had been scheduled for September 21, 2026. Due to the volume of documents submitted and the time required for Chatham-Kent’s legal team to properly review the materials, the court date has been rescheduled to November 17, 2026. The additional time will allow the Municipality and its legal team to thoroughly review the materials and prepare for the proceedings.
The Municipality has also been in contact with the Ministry of the Environment, Conservation and Parks in order to seek answers from the community about how the province intends to approach community feedback on the York1 proposal. In that meeting the MECP confirmed that there will be an opportunity for community feedback through the Environmental Registry of Ontario process.
It is anticipated that once released through the provincial ERO website, the community will have at least 45 days to provide comments. The estimated date of the posting to the provincial website is not yet known. The Municipality will share information about the comment period with the community once it becomes available.
Findings from the Municipality’s expert review will be made available to the public through the Defend Dresden Let’s Talk page as they become available.
As a reminder, the ongoing court case is not a final determination of whether York1 can proceed with its proposed landfill and waste processing project. The court case only deals with whether local zoning requirements apply to York1’s proposed project. York1 has commenced a court application against the Municipality, arguing that it does not require zoning approvals. However, current zoning for the site does not permit a landfill or a large-scale waste processing facility. As a result, the Municipality is responding to York1’s court application and maintains that zoning approvals are required.
The Municipality will continue to keep residents informed as the legal and provincial review processes move forward, including sharing information about opportunities for residents to provide feedback.
