
A Chatham-Kent police officer is facing more sexual assault charges stemming from an investigation by the Special Investigations Unit.
As a result of the SIU investigation which looked into a May 4, 2013 sexual assault allegation made by a 33-year-old woman, 46-year old Const. Kenneth Miller with the Chatham-Kent Police Service is now facing the following charges under the Criminal Code:
– One count of sexual assault, contrary to s. 271; and
– One count of breach of trust by public officer, contrary to s. 122.
Const. Miller is required to appear before the Ontario Court of Justice at 425 Grand Avenue West in Chatham on April 4, 2017.
“The matter is now properly before the courts,” SIU officials stated.
“In consideration of the fair trial interests of the accused, the SIU will make no further comment.”
Const. Miller faces the same two charges stemming from an incident, which allegedly took place on August 23, 2015 as well.
SIU officials say at around 2 a.m. on that day, a 23-year-old woman encountered a Chatham-Kent Police officer and was driven in a marked cruiser to a parking lot in the Orangewood Boulevard area.
The woman was allegedly sexually assaulted, SIU officials stated.
Const. Miller has also been charged under the Police Services Act with ‘Discreditable Conduct’.
He has been suspended from duty since August 27, 2015.
The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault.
