The Ontario Superior Court of Justice has ordered the discontinuance of the proposed class action related to the August 26, 2021 Wheatley explosion, Municipal officials said on chatham-kent.ca on Oct. 19, 2025.
The proposed class action, filed on November 18, 2022, sought damages on behalf of Wheatley residents and businesses against the Corporation of the Municipality of Chatham-Kent and HSE Integrated Inc., Municipal officials added.
On October 7, 2025, Justice Raikes ordered that the action be discontinued with prejudice and without costs.
Under Ontario’s Limitations Act, 2002, the limitation period to file an individual action for damages from the explosion is two years. However, because the class action temporarily suspended the limitation period, there are 283 days remaining to start an individual claim. The deadline to commence an action is July 17, 2026.
The notice was approved by the Ontario Superior Court of Justice, which cannot respond to questions about the matter.
