OPP: Impaired driver, disqualified driver, unmarked cigarettes

Impaired driving charges

Chatham-Kent OPP officials say on February 4, 2017, around 1:30 a.m., a Chatham-Kent Ontario Provincial Police (OPP) officer was on general patrol on Park Avenue East when he observed a brown GMC pick-up truck committing a traffic violation.

The vehicle was stopped and while speaking with the driver, the officer determined the driver had consumed alcohol. A roadside screening test was administered and the driver registered a “Fail”. The driver was transported to the detachment for further tests.

As a result, the male driver, 34-years-old from Bothwell, was charged with drive motor vehicle with more than 80 milligrams of alcohol in blood, contrary to the Criminal Code of Canada.

The accused is required to appear before the Ontario Court of Justice on March 1, 2017 to answer to the charge.

Chatham-Kent Ontario Provincial Police (OPP) want to remind the public that as the weather starts getting warmer more traffic will be appearing on our roadways. The OPP will actively monitor the “Big 4” driving behaviours; impaired driving, speeding, distracted driving, and seatbelt usage.

Disqualified driver

Chatham-Kent OPP officials say on January 31, 2017 at approximately 3 p.m., Chatham-Kent Ontario Provincial Police (OPP) conducted a traffic stop on Communication Road near Fairview Line. The vehicle’s validation sticker was expired and the driver was found to be disqualified from driving.

As a result, the male driver, 52-years-old from Chatham was charged with:

– driving while disqualified x 2, contrary to the Criminal Code of Canada,

– operate a motor vehicle without insurance, contrary to the Highway Traffic Act,

– use plate not authorized for vehicle, contrary to the Highway Traffic Act, and

– fail to apply for permit on becoming owner, contrary to the Highway Traffic Act.

The accused was released on an Appearance Notice to appear before the Ontario Court of Justice on March 31, 2017.

The vehicle was impounded for 45 days.

Unmarked cigarettes seized

Chatham-Kent OPP officials say on January 29, 2017 at approximately 4 p.m., Chatham-Kent Ontario Provincial Police (OPP) conducted a traffic stop on Highway 401 near Scane Road.

During the stop, police located several cartons of unmarked cigarettes and open liquor in the motor vehicle.

As a result, a 68-year-old Windsor resident was charged with Adult possess unmarked cigarettes, contrary to section 29(2) of the Tobacco Tax Act, and a 41-year-old Windsor man was charged with the following offences;

– Adult Possess unmarked cigarettes, contrary to section 29 (2) of the Tobacco Tax Act, and

– Adult having liquor in open container, contrary to section 31(2) of the Liquor Licence Act

Both accused were issued fines and the tobacco and liquor was seized.
