The Municipality of Chatham-Kent says it will vigorously oppose a court action launched by York1 Environmental Waste Solutions Inc. involving a Dresden-area property on Irish School Road.
Municipal officials confirmed the municipality was served with a court challenge in the Ontario Superior Court of Justice on November 14.
“The Municipality of Chatham-Kent strongly disagrees with this argument and will be vigorously defending the action and seeking a court order requiring York1 to seek approvals from Chatham-Kent Council.
York1 is arguing that its operation at 29831 Irish School Road does not require zoning or official plan approvals from council, relying on the legal concept of legal non-conforming use, Municipal officials say.
Chatham-Kent says it has consistently told York1 that land use planning approvals are required.
Municipal legal counsel reiterated the need for those approvals in correspondence sent over the past two weeks.
Officials said more information will be shared publicly as the matter progresses.
